Abstract

The legal space left by the Paris Convention to the member states of the Union is called asymmetry. The implementation of the Paris Convention is based on the application by Member States of the principle of national treatment, which is enshrined in Article 2(1) of the Convention, which reads as follows: “With regard to the protection of industrial property, nationals of each country of the Union shall enjoy in all other countries of the Union the same benefits as are granted in now, or will thereafter be granted by appropriate laws to their own nationals, without prejudice to the rights specifically provided for in this Convention...”.
